Terms of Service

These Terms are an agreement between you and Brett Berry, who provides FieVol as an individual (“FieVol”, “we”, “us”). They cover the FieVol iPhone app, the websites at fievol.com and app.fievol.com, and the voice service behind them (together, “FieVol”). Our Privacy Policy explains what we do with your information.

1Agreeing to these Terms

By creating an account or using FieVol, you agree to these Terms and confirm you’ve read the Privacy Policy. If you don’t agree, don’t use FieVol. If you use FieVol for a club, team or other organization, you confirm you’re allowed to accept these Terms for it, and they apply to it too.

2Who can use FieVol

  • You must be at least 18 years old.
  • You can’t use FieVol if U.S. law bars you from receiving it, including if you’re on a U.S. government list of restricted parties or live in a country the U.S. embargoes.
  • Give accurate information when you sign up, and keep it up to date.
  • Your account is for you alone. Keep your password and your devices secure. You’re responsible for what happens on your account. If you think someone else has used it, change your password and tell us at support@fievol.com.

3What FieVol does

FieVol is a push-to-talk voice service. You can create or join groups, organize them into teams, and talk on their channels by holding a button. Group owners, and the people they choose, can invite others with codes and links, give people roles, mute members and post briefings.

  • Voice is live. When you talk, FieVol sends your voice to the people listening on that channel as you speak. We don’t record it (see the Privacy Policy). People listening could record you with another device, so speak with that in mind.
  • FieVol needs an internet connection. Transmissions can be delayed, cut off or lost.
  • FieVol changes. We may add, change or remove features. If we remove something you pay for, we’ll tell you first.

4FieVol is not for emergencies

FieVol isn’t an emergency service. It doesn’t connect to 911 or any other emergency number. It depends on mobile data or Wi-Fi, on Apple’s services and on our servers, and any of them can fail without warning. Don’t rely on FieVol where a missed or late transmission could put anyone at risk. In an emergency, call 911 or your local emergency number.

Use FieVol only where it’s safe and legal, and follow the law on using a phone while driving or operating vehicles or equipment.

5Groups, teams and roles

  • Anyone with a verified account can create a group and becomes its owner. Owners and admins manage the group’s members, roles, teams, invites and briefings. Dispatchers and team leads can do some of these things, as the app shows.
  • Group owners are responsible for how they run their groups, including whom they invite and what their briefings say. Rules a group sets for its members, such as a club’s own rules, are between the group and its members. We aren’t part of those arrangements.
  • People who manage a group’s invites can see who made each invite link and who joined with it.
  • A group’s owner or admins can remove you from it. If a group is deleted, everyone loses access to its channels.
  • A group always has one owner. If you delete your account, each group you own passes to its admin, who becomes its owner; a group with no admin is deleted, with its teams, channels, invites and transmission records. To choose who takes over, make that person the group’s admin first. A group uses its owner’s plan, so a group that passes to someone without Pro loses what Pro gave it (section 9).

6Your content

“Your content” is what you add to FieVol: what you say on channels, your name and handle, the names of groups and teams you create, the briefings you write, and anything else you send.

  • You keep ownership of your content.
  • You give us a worldwide, non-exclusive, royalty-free license to host, store, relay, copy and display your content, only to run FieVol for you and the people you share it with and to keep FieVol safe. The license ends when your content is deleted, except for copies the Privacy Policy says we keep.
  • You’re responsible for your content, and you must have the right to share it.

7Zero tolerance for abuse

We don’t tolerate objectionable content or abusive users. Don’t use FieVol to:

  • harass, bully, threaten or intimidate anyone;
  • attack people for their race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability or similar traits;
  • share sexual content involving a minor, which we report to the National Center for Missing & Exploited Children, or share sexual content with anyone who hasn’t agreed to receive it;
  • encourage violence, terrorism or self-harm;
  • impersonate a person or organization, or mislead people about who you are;
  • share someone’s private information without their permission;
  • send spam, or add people to groups against their wishes;
  • break the law, help someone else break it, or infringe anyone’s intellectual property or privacy;
  • interfere with FieVol: hack it, overload it, scrape it, get around its limits, mutes or removals, or get into accounts or groups you aren’t allowed into.

FieVol refuses names and briefings that contain offensive words. Group owners and managers can also mute people and remove them from their groups.

8Reporting and blocking

  • Report a person or a group in the app, or email support@fievol.com with the group, the person and what happened. A report in the app sends us the reason you choose, any details you add, and a copy of the names, profile picture and briefing as they were when you reported them.
  • We review every report within 24 hours. When something breaks these Terms, we act on it: we may remove a profile picture, clear a name or briefing, disable the account responsible, or delete the group. We may also report illegal activity to the authorities.
  • Block anyone, in the app. Then you don’t hear them, your iPhone isn’t woken when they talk, you don’t see their profile picture, and neither of you sees the other’s location. They aren’t told. A block isn’t a report: to tell us about abuse, report it too.

9FieVol Pro and payments

FieVol is free. FieVol Pro adds the team map, zones, the dispatcher role and larger groups. What the Free plan and Pro include, and what Pro costs, is shown in the app before you buy.

  • Only group owners need Pro. A group uses its owner’s plan: when you have Pro, everyone in the groups you own gets what it gives them.
  • Buying Pro. You buy Pro in the iPhone app, through Apple: FieVol Pro Monthly or FieVol Pro Annual, which are subscriptions. Apple charges your Apple Account when you confirm the purchase, and Apple’s terms apply to it. A purchase gives Pro to the FieVol account you were signed in to when you bought it.
  • Renewing and cancelling. A subscription renews automatically at the end of each month or year, and Apple charges for the renewal in the 24 hours before the period ends, unless you cancel at least 24 hours before then. Manage or cancel it in your Apple Account’s subscriptions, in your iPhone’s Settings. When you cancel, Pro lasts until the end of the period you’ve paid for. Deleting your FieVol account doesn’t cancel a subscription.
  • Refunds. Apple handles refunds, under its own policies; ask Apple for one. If Apple refunds a purchase, the Pro it gave ends.
  • When Pro ends, the team map, zones and dispatchers’ powers switch off in the groups you own. A group that has more teams or people than the Free plan allows keeps everyone in it, but no one can be added until it fits the Free plan again. Nothing is deleted, and it all comes back if you get Pro again.
  • Pro from us. We may also give Pro to an account ourselves, for example for testing or support. We may end Pro we gave with 30 days’ notice.
  • We may change Pro’s price. Apple tells subscribers before a new price applies, as its rules require, and you can cancel before then.

10Our rights

FieVol’s apps, websites, software, name and logo belong to us and our licensors. We give you a personal, non-exclusive, non-transferable license to use FieVol under these Terms. You may not copy, change, sell or reverse engineer FieVol, except where the law allows it. If you send us ideas or feedback, we may use them without owing you anything.

11Services from others

FieVol uses services from other companies, including Apple (the App Store, in-app purchases and Sign in with Apple) and Microsoft (Azure, which hosts FieVol). Their terms may also apply to you. We aren’t responsible for services we don’t control.

12Ending your account

  • You can delete your account at any time, in the app or on the website. Deleting it is permanent. The groups you own pass to their admins or are deleted (section 5), and a subscription you bought through Apple keeps running until you cancel it (section 9). The Privacy Policy explains what we delete and what we keep.
  • We may suspend or close your account, or stop providing FieVol to you, if you break these Terms, if the law requires it, or if your account puts other people or FieVol at risk. If we close an account for any reason other than abuse, we’ll tell you first where we can.
  • If we stop offering FieVol altogether, we’ll give at least 30 days’ notice.
  • Sections 6, 10 and 13 to 19 continue to apply after your account ends.

13Disclaimers

FieVol is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that FieVol will be uninterrupted, secure or free of errors, or that every transmission will reach its listeners. Some places don’t allow these exclusions, so some of them may not apply to you.

14Limits on our liability

To the fullest extent the law allows:

  • We aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill.
  • We aren’t liable for harm caused by transmissions that are missed, delayed, cut off or garbled, or by relying on FieVol in an emergency.
  • Our total liability for all claims relating to FieVol is limited to the greater of what you paid us for FieVol in the 12 months before the claim, or US$50.

Nothing in these Terms limits liability that the law doesn’t allow to be limited.

15Your responsibility to us

If someone brings a claim against us because of your content, your use of FieVol, or your breaking these Terms or the law, you’ll cover our reasonable costs of dealing with it, including legal fees, to the extent the law allows.

16Disputes

  • If you have a problem with FieVol, email support@fievol.com first. We’ll try to resolve it within 30 days.
  • These Terms are governed by the laws of the State of Tennessee and by U.S. federal law, without regard to conflict-of-law rules.
  • Any lawsuit about FieVol goes to the state or federal courts for Montgomery County, Tennessee, and you and we agree to their jurisdiction. Either of us may use small-claims court instead where it applies.

17Changes to these Terms

We may update these Terms. We’ll post each new version with its effective date. For changes that matter, we’ll tell you in the app or by email before they take effect, and the app will ask you to accept the new version. If you don’t agree, stop using FieVol and delete your account.

18If you got FieVol from the App Store

  • These Terms are between you and us, not Apple. Apple isn’t responsible for FieVol or its content.
  • Your license to the iPhone app covers Apple devices you own or control, as the App Store’s Usage Rules allow.
  • We, not Apple, are responsible for maintaining and supporting the app.
  • If the app fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund what you paid for the app, if anything. Apple has no other warranty obligation for the app.
  • We, not Apple, handle claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection or privacy laws.
  • We, not Apple, handle claims that the app infringes someone’s intellectual property.
  • You must follow the terms of your mobile carrier and any other service you use with the app.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19General

  • These Terms and the Privacy Policy are the whole agreement between you and us about FieVol.
  • If part of these Terms can’t be enforced, the rest still applies.
  • If we don’t enforce part of these Terms, we can still enforce it later.
  • You may not transfer these Terms to anyone else. We may transfer them to a company that takes over FieVol, for example one we form to run it.
  • We aren’t responsible for delays or failures caused by events beyond our reasonable control.
